General Terms & Conditions (GTC) – Plutoos.ch

(hereinafter “Plutoos”, “we”, “us”)
1. Scope & Acceptance
1.1 These GTC apply to every purchase on Plutoos.ch with delivery address in Switzerland or Liechtenstein.
1.2 Before submitting an order you must actively tick the box “I have read and accept the General Terms & Conditions”; without this consent no contract is formed.
1.3 We archive the version of the GTC valid on the order date and provide it as a PDF on request.
2. Contract Formation & Orders
2.1 Product listings are non-binding invitations to place an offer.
2.2 By clicking “Buy Now” you submit a binding offer. The contract is concluded when we e-mail an order confirmation or dispatch the goods.
2.3 We may limit or refuse orders (e.g. stock errors, payment issues, fraud suspicion) and will inform you via the contact details provided.
2.4 You are responsible for providing complete and accurate billing and delivery information.
3. Products
3.1 Goods are primarily sourced in China, and also from Germany, Switzerland and India, meeting Swiss standards as far as reasonably possible.
3.2 Core range: compatible printer cartridges, vacuum-cleaner spare parts (batteries, filters), household items and accessories.
3.3 Despite care, typos, image or price errors may occur. If a material deviation affects your order you may reconfirm at the correct terms or cancel free of charge.
3.4 Minor colour, size or packaging deviations that do not impair use do not constitute a defect.
4. Prices, Payment & Retention of Title
4.1 All prices are in Swiss francs (CHF) including statutory VAT.
4.2 Prices and assortment may change at any time before a contract is formed.
4.3 Accepted payment methods are shown at checkout (PostFinance, Twint, major credit cards, etc.); payment is due immediately.
4.4 Goods remain our property until paid in full.
5. Shipping & Delivery
5.1 Free shipping within Switzerland and Liechtenstein.
5.2 In-stock orders placed Mon–Fri before 14:00 are dispatched the same day; Swiss Post normally delivers within 1–2 business days.
5.3 Delivery times are indicative; delays caused by weather, peak seasons, strikes, force majeure or carrier issues are beyond our control.
5.4 Risk transfers to you once the parcel is handed to Swiss Post. Inspect parcels on receipt and report transport damage immediately.
5.5 No customs duties or import taxes apply for Swiss/Liechtenstein deliveries.
5.6 No pick-up point: our address has no customer reception.
6. Returns & Money-Back Guarantee

6.1 Obtain e-mail approval (info@plutoos.ch) before any return; unsolicited parcels may be securely disposed of.
6.2 Return-shipping costs are always paid by the customer.
6.3 Goods must be packed safely; damage (e.g. leakage) due to poor packaging is not covered.
6.4 Refunds are issued after inspection, to the original payment account in the order name and address.
6.5 Goodwill: We may grant additional refunds or replacements beyond these rules at our sole discretion to keep customers happy.

7.1 Coverage
Covers manufacturing or material defects under normal, intended use, installation, storage and care.
7.2 Special rules for cartridges & toner
- Customer must handle printer settings/work-arounds; firmware issues are excluded.
7.3 Products containing batteries
- Capacity loss of up to ~20 % per year is normal wear and not covered.
- No cover for deep discharge, over-charging, wrong chargers, heat, swelling or leakage.
7.4 Exclusions
- Firmware conflicts, misuse, improper storage/transport.
- Normal wear or performance loss due to intensive use.
- Damage during return caused by inadequate packaging.
7.5 Voluntary one-time guarantee
One (1) free repair or one (1) free replacement per product (replacement may be refurbished). If the same defect re-occurs, you may use statutory rights (price reduction or rescission); no further free replacements.
7.6 Used, refurbished & clearance items
Sold without warranty except for deliberately concealed defects. No return.
7.7 Claim procedure
- Report in writing (e-mail: info@plutoos.ch) within the period and attach proof of purchase.
- Return only after our approval; customer prepays outbound & return shipping.
- If defect confirmed: repair or (refurbished) replacement at our discretion. If excluded: item returned at customer’s cost.
7.8 No extension
A repair or replacement does not extend or restart the original period.
7.9 Transparent pricing & goodwill
We keep prices low, so free multiple replacements or free returns are not feasible. Further goodwill remains at our sole discretion.
8. Limitation of Liability
8.1 We are liable only for direct damages caused by intent or gross negligence. Liability for indirect, incidental or consequential losses (lost data, lost profit, business interruption) is excluded as far as legally permitted. Statutory consumer rights remain unaffected.
9. Data Protection & Security
9.1 Personal data is processed in line with the revised Swiss FADP and our Privacy Policy.
9.2 Checkout is TLS-encrypted.
9.3 Data is stored on Swiss or EEA servers with equivalent protection and is never sold to third parties.
10. Customer Account & Minimum Age
10.1 Creating an account is optional; credentials must be kept secure.
10.2 By ordering you confirm you are at least 18 years old and legally capable of contracting.
11. Force Majeure
Events beyond our reasonable control (natural disasters, pandemics, governmental actions, strikes) release us from delivery obligations for the duration and scope of the disruption.
12. Alternative Dispute Resolution
We aim for amicable settlement. Consumers may use the Swiss ODR platform or the FRC Mediation Service. Participation is voluntary and does not limit statutory rights.
13. Intellectual Property
All content on Plutoos.ch—texts, graphics, logos, software—is protected and may not be used without our prior written consent.
14. Severability
If any clause is held invalid, the remaining provisions remain in force. The invalid clause will be replaced by one that most closely reflects its economic intent.
15. Governing Law & Jurisdiction
These GTC are governed by Swiss substantive law (excluding conflict-of-laws rules and the CISG). Exclusive place of jurisdiction is 8603 Schwerzenbach, unless mandatory consumer provisions dictate otherwise.
16. Amendments & Archiving
We reserve the right to amend these GTC at any time. The version published on Plutoos.ch at the moment of your order (see version/date above) applies to that purchase; later changes have no retroactive effect.
